Terms of Service and F.A.Q.
Do you deliver every image you shoot?
No, we do not. We eliminate duplicate images, test shots, missed focused shots, shots with bad expressions and other images that may dilute the overall product delivery.
Do you do headshots, individual portraits, family portraits, commercial photography, or other types of photography?
Yes, we have experience in many fields of photography.
Do you touch up all the images available for download?
Yes we do. Every image we deliver is post produced with our unique signature style of post-production. This involves color correction, exposure adjustment, selective black and white processing, clarity adjustments, tone-mapping, and other corrections.
What happens if we go over the contracted amount of time?
We understand that not everything goes as planned during a photo shoot. We never pack up before the contracted time, and moreover, we’re not leaving on the dot when the contracted time is up. Instead, we will ask you at the end of your contracted time whether or not you would like to extend. If you would like us to stay, we will charge the rates specified in your contract rounded to the closest 30-minute increment.
When can we expect to see our photos from our photo shoot?
Post-production for photo shoots are completed 1-2 weeks after the date of the shoot. If you require the images to be completed sooner than that, a rush process fee will be charged.
Client Usage
The Client is obtaining prints for personal use only, and shall not sell said prints or authorize any reproductions thereof by parties other than DLB Photography. Without permission from DLB Photography, the Client shall not download, copy, print, screen shot, use as a basis for derivative works, manipulate in any way, or otherwise use the Photographer’s images.
If Client is obtaining a print for reproduction or publication, DLB Photography authorizes Client to reproduce the print only as agreed upon by Client and DLB Photography. In such event, Client shall request that a credit for DLB Photography be placed adjacent to the photograph on publication, but shall have no liability if the publication refuses or omits to do so.
Copyright and Reproductions
All photographic materials, including but not limited to digital files, negatives, transparencies, proofs, and previews, shall be the exclusive property of DLB Photography. DLB Photography shall own the copyright in all images created and shall have the exclusive right to make reproductions.
Torrential Weather
If the weather is torrential and DLB Photography determines shoot is not possible, the session will be rescheduled for another day.
Cooperation & Physical Liability
All parties agree to cheerful cooperation and communication for the best possible result within the definition of this Assignment. DLB Photography is not responsible for missed images due to any individual’s failure to appear or cooperate during the Assignment. If there is any threat to the DLB Photography or our equipment by any subject, we reserve the right to end coverage immediately with no further liability to finish the Assignment, with no refunds given.
Additionally, you responsible for your own conduct and the conduct of all participants in the Session. Any damage to equipment or studio components caused by you or your participants is your sole financial responsibility. You agrees to hold DLB Photography harmless for any injuries or damages sustained preceding, during, and immediately following the Assignment.
Limit Of Liability
In the unlikely event that the DLB Photography cannot compete your photoshoot due to a medical or natural emergency, or other cause beyond the control of DLB Photography, then we shall return the deposit to you but shall have no further liability with respect to the Agreement.
This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of DLB Photography.
In the event DLB Photography fails to perform for any other reason, DLB Photography shall not be liable for any amount in excess of the retail value of your order.
